Software License Agreement for usage of the application on www.myretailcare.com for identifying the necessary legislations, assisting in making the application with the competent authority and recording the same at common repository place (“Services”).

Please read this Software License Agreement (“License”) carefully before creating an account or using any feature of the application.  However, by using the application, you are absolutely agreeing to be bound by the terms of this application. In case you do not agree to the terms of this Licence or change your decision, you can always delete the account or stop using the Licence. However, any amount paid shall not be refunded or adjusted, in any manner. 

Important Note: The application is a copyright design and software code of Legal Buddy and you are only permitted to the extent that this application may be used to read, understand the Legislation and should not be decomposed, copy for any purpose other than permitted use.

1. General.
2. The Application is not sold to you and is only licensed to limited use, as per the subscription option chosen by you. Any use shall be only under, your absolute consent, towards, the terms of use. Legal Buddy retains absolute ownership of the application and reserve all rights not expressly granted to you herein. 

1. Legal Buddy, at its sole discretion, may make available any future upgrades or updates. The terms of this Licence will govern any such upgrades or updates provided by us, unless any new or express separate terms are accompanied with it. 

1. Title And Intellectual Property Rights in and any content displayed (included jpg/png posters or digital materials) belong to Legal Buddy. This limited license to use does not grant any rights to use such contents, except for self-reference. Additionally, you are expressly advice to take a legal opinion before taking any business, personal or other transaction, deed, action and no reliance should be placed on any contents otherwise as we shall not be liable for any loss, charges, fee towards any reliance on any content and even does not warrant / guarantee that any such content will continue to be available to you, in future. 
2. Permitted License Uses And Restrictions.
3. The Licence permission is granted to you for limited purposes, on non-transferable, non-exclusive basis for captive usage, without validation of the content. You agree not to copy, extract or distribute commercially or otherwise, on a standalone basis, any contents, graphics, artwork, audio, video or similar assets (“Digital Materials”).

1. Application Features and Support. We do not guarantee any performance level or delay or deficiency in loading or correctness of any content or material and the contents or material is delayed due to your system configuration. 
2. No Reverse Engineering. You may not and you agree not to enable others to copy decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the Legal Buddy Software or any services provided by the Legal Buddy Software.

1. Compliance With Laws. You agree to use the Legal Buddy Software in compliance with all applicable laws, an internet connection is required for some features of the Legal Buddy Software and services. 

1. Third Party Software. Legal Buddy provides access to certain third party software as a convenience. Please contact the appropriate software vendor, manufacturer or service provider directly for technical support and customer service related to its software, service and/or Products.

1. Automatic Updates. The Legal Buddy Software will periodically check for the updates. 

3. Consent to use of Data. When you use the various communication features of the Legal Buddy Software, at all times your information will be treated in accordance with Legal Buddy’s Privacy Policy.
4. Services and Third Party materials. Neither Legal Buddy nor any of its content guarantees the availability, accuracy, completeness, reliability, or timeliness of information, or any other data displayed by any services. Information displayed by any services is for general informational purposes only and should not be relied upon and is not a substitute of legal advice. 
5. Termination. This License Is Effective Until Terminated. 

6. Disclaimer of Warranties.

You expressly acknowledge and agree that, to the extent permitted by applicable law, use of the Legal Buddy Software and any services performed by or accessed through the Legal Buddy Software is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you.

To the maximum extent permitted by applicable law, the Legal Buddy Software and services are provided “as is” and “as available”, with all faults and without warranty of any kind, and Legal Buddy hereby disclaim all warranties and conditions with respect to the Legal Buddy Software and services, either express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement of third party rights.

1. Legal Buddy does not warrant against interference with your enjoyment of the Legal Buddy Software And Services, that the functions contained in, or services performed or provided by, the Legal Buddy Software will meet your requirements, that the operation of the Legal Buddy Software and services will be uninterrupted or error-free, that any services will continue to be made available, that defects in the Legal Buddy Software or services will be corrected, or that the Legal Buddy Software or services will be compatible or work with any third party software, applications or third party services. 

1. No Oral or Written information or advice given by Legal Buddy shall create a warranty. 

7. Limitation Of Liability. To the extent not prohibited by Indian Laws, in no event shall Legal Buddy, it’s affiliates, agents, Directors, employees be liable for any personal injury or any incidental, special indirect or consequential damages whatsoever, including any loss of profits, loss of data, business interruption or any commercial damages or losses, arising out of your use or inability to use the application or services or any third party software, application in conjunction with Legal Buddy Software, however caused. In no event Legal Buddy’s total liability to you shall not exceed INR 1,000/- (Indian Rupees One Thousand Only).
8. Controlling Law and Severability. This License will be governed by and constructed in accordance with the laws of India. The Courts of Delhi will have any jurisdiction whatsoever in relation to any difference or dispute. 
9. Legal Buddy’s relationship with You Legal Buddy does not process payments or have any control over payments, refunds, or other commerce activity that may arise our of your use of this feature and is does only liable for things expressly agreed herein and for all dispute on charges, fee etc on your credit / debit card or networking should be contacted through your banker.
10. Complete Agreement; Governing Language. This License constitutes the entire understanding / agreement between you and Legal Buddy relating to the Legal Buddy Software and supersedes all prior or contemporaneous understandings regarding such subject matter.  No amendment to or modification of this Licence will be binding unless in writing and signed by Legal Buddy.  

In addition to the disclaimers of warranties and limitation of liability set forth in the License, Legal Buddy does not assume any liability for payments, transactions, or other commerce activity made using the Legal Buddy feature, and you agree to look solely to agreements you may have with your card issuer, or banker to resolve any questions or disputes relating to your supported cards and associated commerce activity
